Please read these terms carefully before using QRbolt services

1. Acceptance of Terms

By accessing and using QRbolt ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

QRbolt is a comprehensive QR code management platform that allows users to create, manage, and track dynamic QR codes. The service is provided by IncudoLABS Inc., a Canadian company registered in British Columbia.

Our services include but are not limited to:

  • Dynamic QR code generation and management
  • Analytics and tracking capabilities
  • Custom domain configuration
  • User management and collaboration features
  • Subscription-based feature access

3. User Responsibilities

As a user of QRbolt, you agree to:

  • Provide accurate and complete information when creating an account
  • Maintain the security of your account credentials
  • Use the service in compliance with all applicable laws and regulations
  • Not use the service for illegal, harmful, or unauthorized purposes
  • Respect the intellectual property rights of others
  • Not attempt to gain unauthorized access to the service or its systems

4. Payment and Billing

QRbolt offers subscription-based services with various pricing tiers. Payment processing is handled by Paddle.com, our authorized payment processor.

Important: Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

By subscribing to our services, you agree to:

  • Pay all fees associated with your chosen subscription plan
  • Automatic renewal of your subscription unless cancelled
  • Payment processing through Paddle.com's secure systems
  • Compliance with Paddle.com's terms and conditions

5. Privacy and Data Protection

Your privacy is important to us. We collect and process personal information in accordance with our Privacy Policy and applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA).

We implement appropriate technical and organizational measures to protect your data and ensure compliance with privacy regulations.

6. Intellectual Property

The QRbolt service, including its design, functionality, and content, is owned by IncudoLABS Inc. and protected by Canadian and international copyright and trademark laws.

You retain ownership of the content you create using our service, but grant us a license to store, process, and display such content as necessary to provide the service.

7. Termination

Either party may terminate this agreement at any time. Upon termination:

  • Your access to the service will be discontinued
  • You may request deletion of your account and associated data
  • Any outstanding fees remain due and payable
  • Provisions that by their nature should survive termination will remain in effect

8. Limitation of Liability

To the maximum extent permitted by law, IncudoLABS Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability to you for any claims arising from or related to this agreement shall not exceed the amount you paid for the service in the twelve months preceding the claim.

9. Governing Law

This agreement shall be governed by and construed in accordance with the laws of British Columbia, Canada. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts of British Columbia.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the service. Continued use of the service after changes constitutes acceptance of the new terms.

11. Cannabis Services Disclaimer (Canada)

Important: This section applies specifically to QRbolt's services related to cannabis industry GS1 Digital Link QR code generation in Canada. For European jurisdictions, separate addendums will be added as needed based on local regulations.

Statement of Purpose: QRbolt provides software-as-a-service for GS1-compliant digital link QR codes. Our service is a neutral technology tool designed to help businesses generate compliant barcodes according to GS1 standards.

Disclaimer of Affiliation: QRbolt is not affiliated with, and does not endorse, any cannabis producer, distributor, or retailer. We do not produce, handle, sell, or promote cannabis or cannabis-related products. QRbolt is a technology service provider offering GS1 labeling tools, and our relationship with users is limited to providing software services.

User's Sole Responsibility: Users are solely responsible for ensuring that all content linked to or associated with QR codes generated through our service complies with all applicable federal, provincial, and municipal laws, including but not limited to the Cannabis Act and its regulations concerning promotion, packaging, and labeling as enforced by Health Canada.

Compliance with Promotion Prohibitions: Users are expressly prohibited from using QRbolt services to create QR codes that link to content that promotes cannabis in a manner that is prohibited by law. This includes lifestyle advertising, testimonials, or any content that could be appealing to young persons, as prohibited under Health Canada's regulations.

Canadian Market Only: Cannabis-related services provided by QRbolt are available for the Canadian market only, where cannabis is federally legal. Cannabis legalization varies by jurisdiction globally, and QRbolt's cannabis services are specifically designed for Canadian cannabis producers operating under Health Canada's regulatory framework.

Regulatory Compliance: While GS1 standards are industry best practice for Health Canada's lot-level traceability requirements under the Cannabis Act, they are not explicitly mandated by the Act. Users must ensure their use of GS1 Digital Links meets all applicable Health Canada requirements for cannabis product labeling and traceability.

Indemnification: The user agrees to indemnify and hold harmless QRbolt, its affiliates, officers, and employees from any and all claims, liabilities, damages, and expenses arising from the user's non-compliance with applicable laws or regulations, including but not limited to violations of the Cannabis Act or Health Canada regulations.

No Legal Advice: The information provided by QRbolt regarding GS1 standards and cannabis compliance is for informational purposes only and does not constitute legal advice. Users should consult with qualified legal professionals and regulatory experts to ensure full compliance with all applicable laws and regulations.

12. Alcohol, Tobacco, and Controlled Substances Services Disclaimer

Important: This section applies specifically to QRbolt's services related to alcohol, tobacco, and other controlled substances industries using GS1 Digital Link QR code generation.

Statement of Purpose: QRbolt provides software-as-a-service for GS1-compliant digital link QR codes. Our service is a neutral technology tool designed to help businesses generate compliant barcodes according to GS1 standards. QRbolt does not provide legal, regulatory, or compliance advice specific to alcohol, tobacco, or controlled substances industries.

We do not produce, handle, sell, distribute, or promote alcohol, tobacco, or controlled substances. QRbolt is a technology service provider offering GS1 labeling tools, and our relationship with users is limited to providing software services.

User's Sole Responsibility: Users are solely responsible for ensuring that all content linked to or associated with QR codes generated through our service complies with all applicable local, state, provincial, federal, and international laws governing their industry and products. This includes but is not limited to:

  • Alcohol: Compliance with regulations from bodies such as the Alcohol and Tobacco Tax and Trade Bureau (TTB) in the US, Health Canada, and equivalent agencies in other jurisdictions. Requirements may include age verification, health warnings, ingredient disclosure, excise tax compliance, and responsible consumption messaging.
  • Tobacco: Compliance with regulations from bodies such as the US Food and Drug Administration (FDA), Health Canada, and the EU Tobacco Products Directive (TPD). Requirements may include track-and-trace mandates, anti-counterfeiting measures, health warnings, age-gating, and strict prohibitions on promotional content.
  • Controlled Substances: Compliance with all applicable controlled substances regulations, which vary significantly by jurisdiction. Users must ensure full compliance with all relevant laws and regulations in their operating jurisdictions.

Age Verification and Content Restrictions: Users are responsible for implementing appropriate age verification mechanisms on any web pages or content linked from QR codes for age-restricted products. For tobacco products, users are expressly prohibited from using QRbolt services to create QR codes that link to promotional, marketing, or lifestyle content. All linked content must be purely informational and compliant with applicable advertising restrictions.

Regulatory Compliance: GS1 Digital Link standards are used for traceability, batch/lot tracking, and providing supplemental product information. However, users must ensure their implementation meets all specific regulatory requirements for their product category and jurisdiction. GS1 standards may be recommended or required for certain traceability programs (e.g., FSMA Rule 204 for food safety, TPD track-and-trace for tobacco), but users remain responsible for full regulatory compliance.

Service Termination: QRbolt reserves the right to terminate or suspend services to any user found to be using the platform in violation of applicable laws or regulations, or to circumvent regulatory requirements. QRbolt may also refuse service to users whose products or business practices violate our terms of service or applicable laws.
